Terms of use

Short, and specific to this product. The two clauses most people are actually looking for — how to delete your data, and how refunds work — are sections 7 and 5.

1. What you are agreeing to

These terms cover the Superheat mobile app, this website, and the instructor console. Using any of them means you accept these terms. If you do not, do not use them; if you have already paid and you do not accept them, ask for a refund under section 5.

Superheat is exam practice material. It is not a certification, not a licence, and not affiliated with, endorsed by, or approved by the U.S. Environmental Protection Agency. See the disclaimers.

2. Your licence

You get a personal, non-exclusive, non-transferable licence to use Superheat to prepare for the EPA Section 608 certification exam, on devices you control.

You may not:

  • Copy, scrape, republish or resell the question bank or any substantial part of it.
  • Use the questions to build a competing bank, including as training data.
  • Share a cohort seat code with anyone it was not issued to.
  • Reverse-engineer the app except to the extent that law permits regardless of contract.

The text of 40 CFR quoted throughout the product is a work of the United States Government and is not subject to copyright protection in the United States. That text is yours to use freely. The questions, explanations, software and design are not.

3. Purchase terms

One-time, non-consumable, no subscription. $24.99 for Core plus one certification type, $39.99 for all four. If you own one type, upgrading to all four costs $19.99 — the difference, not the full price again.

There is no recurring charge, no renewal date, no free trial that converts into a charge, and nothing to cancel. You will not be billed again. If you ever see a recurring charge described as Superheat, it is not us; tell us and tell your card issuer.

Purchases made inside the app are processed by Apple or Google under their terms. Access is tied to the store account you bought with, not to an account with us, because there is no account with us.

An entitlement is cached on your device and remains valid for 30 days without a successful check with the store, so you do not lose access where there is no signal. After 30 days offline the app asks to reconnect once before restricting paid features.

Prices are in US dollars and exclude any tax the store or Stripe collects. We may change prices for future purchases; a price change never affects something you have already bought.

4. Restoring a purchase

New phone, or reinstalled the app: open Superheat and use Restore purchases. Your entitlement comes back from the App Store or Google Play account you bought with. There is no login and no code to keep.

Your answer history does not come back, because it was never uploaded. That is the direct cost of not having accounts, and we would rather state it here than have you discover it.

If restore does not find your purchase, write to support@superheatprep.com with the store receipt and we will work it out with you.

Nothing here limits a refund right you have under consumer law where you live; where those rights are wider than this section, they apply.

6. Cohort seats

Seats are $8 each with a minimum of 20 per purchase, invoiced through Stripe. Buying seats creates an instructor console account for the address on the order.

  • An unredeemed seat expires 180 days after it is issued. A redeemed seat expires 90 days after redemption.
  • A seat is anonymous: an alias and a code. As the instructor you must not attempt to record a student’s identity in the alias field, and the system rejects an alias containing an “@”.
  • Refunds are pro-rata on unredeemed seats. Ask within the seat validity period and we refund $8 for each seat nobody has entered. A redeemed seat is not refundable, because it has been used.
  • Seats are for the students of the program that bought them. Reselling them is not permitted.
  • You may delete a seat at any time, which deletes the progress pings attached to it.

7. Deleting your data

If you use the app anonymously: uninstall it. That removes every piece of data the product holds about you — your answers, your readiness figures, your review schedule, your mock exams, your exam date and your settings — because all of it lives in the app’s own storage on your phone and there is no server copy. Not a backup, not an archive, not an analytics record joined to you. We cannot delete it for you, and we could not restore it if you asked us to.

One thing survives uninstalling and is worth knowing: your purchase. It is held by Apple or Google against your store account, which is what lets Restore purchases work if you come back.

If you hold a cohort seat: uninstalling removes everything on your device. Email privacy@superheatprep.com with the seat code to have the seat and its four-field pings deleted from our side too, or ask your instructor to delete the seat.

If you are an instructor: email privacy@superheatprep.com to delete your account. That cascades to your cohorts, their seats and their pings.

The retention schedule sets out what is kept, for how long, and what deletes it.

8. Acceptable use

Do not attempt to break, overload or gain unauthorised access to the service; do not use it to break the law; do not attempt to obtain another instructor’s roster; and do not automate bulk extraction of the question bank. If you are looking for a vulnerability in good faith, there is a page for that and you are welcome.

9. Content, accuracy and corrections

Every question is written from a specific paragraph of 40 CFR Part 82, Subpart F, cited and quoted on the card, and checked against a dated snapshot of the eCFR. We take that seriously and it is the whole point of the product. It is not a guarantee that every item is correct.

Regulations change. A question that was right against one snapshot can be wrong against the next, and there is a lag between the Federal Register and our next content release. Where the app and the regulation disagree, the regulation is right — the citation on the card is there so you can check.

If you find an error, report it from the question or write to support@superheatprep.com with the item id. We will correct or retire the item. How items are checked.

10. No certification, no professional advice

Superheat does not certify anyone and cannot. EPA Section 608 certification is issued only by a certifying program approved under 40 CFR § 82.161, and only after that program administers its own test. A completion record from this product records practice completed in an app and nothing else.

Nothing here is legal advice or engineering advice. Do not rely on it to decide whether a particular job complies with the regulation. Read the regulation, and ask someone qualified.

A readiness figure is an estimate from practice answers. It is not a score, not a prediction, and not connected to any certification test.

11. Availability

The app is built to work offline, so the parts of it you actually study with do not depend on us being up. The website, the instructor console and the cohort endpoints are provided as they are and may be unavailable for maintenance or for reasons outside our control. We do not offer an uptime commitment; if a training program needs one, ask before buying.

12. Disclaimer and limitation of liability

To the fullest extent the law allows, Superheat is provided “as is” and without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the material is error-free or that using it will result in passing any examination.

To the fullest extent the law allows, our total liability arising out of or relating to Superheat is limited to the amount you paid for it in the twelve months before the claim, and we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or the cost of substitute material.

Some jurisdictions do not allow some of these exclusions or limitations. Where that is so, they do not apply to you and the rest of this section still does.

13. Changes

We may change these terms. The updated date at the top changes when we do. A change that materially reduces what you have already paid for does not apply retroactively to that purchase.
